1. The service
The Kolekt EPR Wizard ("the Wizard") is provided by [Legal name of the company, e.g. "… B.V."] ("Kolekt", "we", "us"). It lets governments, advisers and other professionals design Extended Producer Responsibility (EPR) legislation: one hundred design choices, each starting on Kolekt's recommendation, with their estimated effect on the time to a working EPR system, on EPR revenue and on the support of the main stakeholders. For some countries it adds the legal route to that design and draft legal texts.
By creating an account or using the Wizard you accept these terms.
2. Your account
- An account is for one person. Give your real name and organisation, and keep your password to yourself.
- You are responsible for what is done with your account. Tell us at info@kolekt.com if you think someone else has used it.
- We may suspend or close an account that breaks these terms, and we will tell you why unless the law or the safety of the service prevents it.
3. Not legal advice
The Wizard is a design and planning tool. Its figures are the result of a model: some come from Kolekt's own EPR programme tables, others are directional estimates and are marked as such on each choice. Implementation times, revenues and popularity scores are estimates for comparing designs, not forecasts for a particular country.
Country routes and draft legal texts are prepared from public legal sources and are marked with how far they have been checked. Unless a document says it has been verified by counsel admitted in that country, it has not been. Nothing in the Wizard is legal advice. Have any text reviewed by qualified lawyers in the jurisdiction before it is used, submitted or relied on.
4. Country documents
- Access to a country's documents is granted by Kolekt, per country and per account, and may be limited in time.
- Every document generated carries your name and a unique reference, and each generation is recorded (who, when, which scenario and which version of the country content).
- You may use a generated document for the policy or legislative work for which access was granted, within your organisation and with the public bodies involved in that work.
5. Kolekt's rights
The Wizard, its design choices and their texts, the impact model and its figures, the country legal profiles and the document templates belong to Kolekt or its licensors. These terms give you the use described here and nothing more. You may not copy the model or the country content as a whole, publish it, sell it, or use it to build a competing product.
6. Acceptable use
- No automated collection (scraping) of choices, figures or documents.
- No attempt to get around access controls, rate limits or watermarks.
- No use that breaks the law or the rights of others.
7. Your scenarios
The scenarios you create, and the settings you give them, are yours. We store them to provide the Wizard to you. People you share a scenario with can see it, and edit it if you allow that; you can withdraw a share at any time. We do not publish your scenarios.
8. Cited publications
Choices cite publications, many of them listed on epr-references.net. They are cited for information; their rights stay with their authors and publishers, and the links lead to the original records.
9. Availability and changes
We work to keep the Wizard available and correct, but provide it as it is. We may change features, figures and country content; a new version of a country's content is released as a new version, and documents record the version they were made from.
10. Liability
To the extent the law allows, Kolekt is not liable for indirect or consequential loss, or for decisions taken on the basis of the Wizard's estimates or draft texts. [Liability cap and carve-outs to be confirmed.]
11. Law and disputes
